A code of practice published by the Department of Health in 2004, Confidentiality and Disclosure of Information: General Medical Services (GMS), Personal Medical Services (PMS), and Alternative Provider Medical Services (APMS) Code of practice, sets out the circumstances in which disclosure of identifiable information would be “reasonably required” by the PCT. The code says that identifiable information should only be shared where it is not possible or practicable to anonymise the data (paragraph 30) and where it is not practicable to seek patient consent (paragraph 32). This is consistent with our guidance on secondary and research uses of identifiable data.
